To take advantage of the
ev.energy MA Incentive the following terms and conditions apply:
1. The Promoter
The Promoter is EV DOT ENERGY LTD of 86-90 Paul Street, London, England, EC2A 4NE.
2. Participation Eligibility
In order to qualify, you must be over the age of 18, a resident of the state of Massachusetts, and complete these requirements:
a. download the ev.energy app on the iOS App Store or Google Play Store for Android;
b. create an ev.energy account and accept the ev.energy app terms and conditions;
c. connect a compatible electric vehicle (“EV”) OR compatible connected charger (“EVSE”) (see
https://www.ev.energy/drivers/integrations for our list of compatible EVs and compatible connected chargers);
d. if your EV or EVSE is Smart Charging capable, enable (turn on) the Smart Charging feature in the Smart tab settings in the ev.energy app (if your EV and EVSE are not Smart Charging capable, this is not a requirement to participate and earn incentives); and
e. complete at least 1 charging session per month of participation, as verified by ev.energy.
Individuals who qualify as set out in Section 2 will be “Eligible Participants”
3. Incentives Eligibility
3.1 Enrollment Incentive: Eligible Participants may earn a one-time $20 Enrollment Incentive after they have completed their first charging session over 5kWh energy delivered consumed between the hours of 9:00pm EST and 12:00pm EST on the ev.energy platform, to be paid via the participant’s choice of Paypal or Venmo within 30 days of eligibility.
3.2 Monthly Incentive: Each calendar month after their date of enrollment, Eligible Participants who have completed a minimum of 1 charging session and 80% of their kWh energy delivered consumed between the hours of 9:00pm EST and 12:00pm EST within 30 days will receive a $5 Monthly incentive, to be paid via the participant's choice of PayPal or Venmo within 30 days of eligibility.
3.3 Eligible Participants shall set up an account with PayPal, Venmo, or other payment processing app designated by the Promoter (“Payment Processing App”). Eligible Participants shall be solely responsible for maintaining such Payment Processing App and any related accounts for the Term of the Program. Eligible Participants shall comply with any Terms of Use and/or Privacy Policies available on the Payment Processing App
4. Miscellaneous
4.1 The incentives can only be redeemed once per each EV connected to the ev.energy app, either via EV telematics or a connected EVSE.
4.2 The Promoter has the absolute right to determine how the cash equivalent offer is made available to the Eligible Participant for redemption.
4.3 The Promoter retains the right to amend or cancel this program without notice and without prejudice.
4.4 The Promoter is not responsible for any taxes which may be imposed on an Eligible Participant as a result of the incentive payments.
4.5 The Promoter will have sole discretion to decide on the final resolution of any issues related to the ev.energy CPS MA Incentive.
4.6 Eligible Participants will cooperate in good faith with the Promoter in performing evaluation, measurement and verification (“EM&V”) of the Program. The Promoter will use anonymized data collected from Eligible Participants to evaluate the Program and for future planning purposes, including, but not limited to, assessing user experience, and reducing emissions. Additionally, the Promoter may request that Eligible Participants complete surveys during and after the conclusion of the Program. By participating in such surveys, you understand and agree that the Promoter may use and publicize quotes from Eligible Participants’ surveys in promotional materials. The Eligible Participants may opt-out of this data collection at any time by contacting
support@ev.energy.
5. Limitation of Liability
5.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Eligible Participant or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the incentive except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
6. Data Protection6.1 The Promoter will only process your personal information in accordance with the ev.energy
Privacy Policy.
7. General
7.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude the Eligible Participant from participation and eligibility in the ev.energy CPS MA Incentive.
7.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the participation criteria or incentives where it becomes necessary to do so.
7.3 These terms and conditions shall be governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts, United States of America.
8. Partner Offers8.1 Eligible Participants who have signed up the CPS MA Incentive program via a link provided by Select Partners will be eligible for the Promoter’s premium solar product for a period of six months at no cost. To access this benefit Eligible Participants will need to use the same email address associated with their Sunrun account. Participants wanting to remain on the premium solar product following the six months will be able to pay $10 per month or $100 per year to keep the product. Participants who do not wish to keep the premium solar product will revert to the solar + grid product. This does not impact the Participant’s ability to use the app.
